Doula Villages Privacy Policy

Thanacare LLC (collectively with its subsidiaries, affiliates, and related entities, "Company," "the Company," "Thanacare," "we," "us," and "our") respects your privacy and is committed to protecting it through our compliance with this Privacy Policy (the "Policy"). This Policy applies to the Doula Villages platform located at doula.yourvillages.org (the "Platform") and should be read in conjunction with the Doula Subscription Terms (for doulas) and the Client Terms of Use (for clients), each of which is incorporated by reference into this Policy.

This Policy describes:

  • The types of information we collect from doulas who subscribe to the Platform ("Doulas") and from individuals or families who participate as clients of those Doulas ("Clients").
  • Our practices for collecting, using, maintaining, protecting, and disclosing that information.

The Platform is operated by Thanacare on behalf of Doulas. With respect to information about Clients that is submitted to the Platform by a Doula or by a Client at the Doula's direction, the Doula is the controller of that information and Thanacare is a service provider or processor (as those terms are used in applicable privacy law). With respect to information about Doulas that is collected directly by Thanacare in connection with the subscription, Thanacare is the controller.

This Policy does not apply to information collected by us offline or through any other means, including on any other website, product, or platform instance operated by the Company or any third party. Other products and platform instances operated by the Company are governed by their own separate privacy policies.

Please read this Policy carefully to understand our practices regarding your information and how we will treat it. If you do not agree with our policies and practices, then please do not use the Platform. By using the Platform, you agree to the terms of this Policy. This Policy may change from time to time (see below, "Changes to this Policy"). Your continued use of the Platform after we make changes is deemed to be acceptance of those changes, so please check the Policy periodically for updates.

What We Collect and How We Collect It

To provide the Platform to Doulas and to enable Doulas to coordinate care with their Clients, we collect, store, use, and share information in accordance with this Policy and applicable law.

Information We Collect from Doulas

When a Doula subscribes to and uses the Platform, we collect Personal Information about the Doula, including:

  • first and last name;
  • email address;
  • telephone number;
  • mailing address;
  • business name and any related professional information;
  • payment and billing information (processed through our payment processor);
  • account credentials;
  • the Doula's logo, branding, and content uploaded to the Platform; and
  • communications, comments, and content the Doula submits to the Platform.

Information We Collect from Clients

When a Client uses the Platform at the invitation of a Doula, we collect Personal Information about the Client, including:

  • first and last name;
  • email address;
  • telephone number;
  • date of birth (if provided);
  • relationship to a Doula and to other Clients;
  • health-related information about the Client (such as pregnancy, postpartum, or wellness information) that the Client or the Doula submits to the Platform;
  • documents uploaded to the Platform; and
  • communications, comments, and content submitted to the Platform.

The categories and amount of Client information collected depend on the features of the Platform used by the Doula and the Client.

Important Information Relating to Health Information and HIPAA

Solo doulas are generally not "covered entities" as defined under the Health Insurance Portability and Accountability Act of 1996, as amended ("HIPAA"). The Platform is not designed for the processing of Protected Health Information ("PHI") as defined under HIPAA, and information submitted to the Platform is generally not subject to HIPAA. Information about a Client's pregnancy, postpartum experience, wellness, or general health that is submitted to the Platform may nonetheless constitute "consumer health data" or similar categories under state privacy laws, and is handled in accordance with this Policy and those laws. If a Doula operates under or as part of a HIPAA-covered entity, the handling of any PHI is governed by an additional Business Associate Agreement between that covered entity and Thanacare; the Doula is responsible for advising the Client whether such an arrangement applies.

Automated Information Collection

In addition to the information that you provide to us, we may also collect information automatically during your use of the Platform. We collect this information using automated tools that may collect information about your behavior and your computer system, such as your internet address (IP Address), the pages you have viewed, browser type, operating system, and the actions you have taken while using the Platform. Some of the tools we use to automatically collect information may include:

  • Cookies. A "cookie" is a small data file transmitted from a website to your device's storage. Cookies are usually defined in one of two ways, and we may use either (or both) of them: (1) session cookies, which do not stay on your device after you close your browser, and (2) persistent cookies, which remain on your device until you delete them or they expire. We use the following categories of cookies on the Platform:
  • Strictly Necessary Cookies. These cookies are essential in order to enable you to access the Platform and use its features, including authentication and session management. Without these cookies, services you have requested cannot be provided.
  • Functionality Cookies. These cookies remember choices you make to provide you with an experience more appropriate to your selections.
  • Performance Cookies. These cookies collect information on how you use the Platform to help us understand how the Platform is being used and to highlight areas where we can improve. The data stored by these cookies is used in aggregate.

The Platform does not use targeting or advertising cookies, and we do not sell or share your information with third-party advertising networks. Where required by law, we honor opt-out preference signals such as the Global Privacy Control ("GPC"). You may turn off cookies at any time by modifying your internet browser's settings; however, by disabling cookies, you may be prohibited from full use of the Platform's features.

  • Server logs and security telemetry. We collect logs of activity on the Platform, including IP addresses, timestamps, and actions taken, in order to operate, secure, and audit the Platform.

Your Choices and Selecting Your Privacy Preferences

The Platform sends operational, transactional, and service-oriented communications (such as account notifications, authentication, and messages from your Doula) that are necessary for the operation of the Platform. We do not send marketing communications from the Platform unless we obtain your express consent.

Text Messaging. If you provide a mobile telephone number to the Platform and consent to receive text messages, you may receive text messages relating to authentication or messages from your Doula. You may opt out at any time by following the instructions provided in the message or by contacting us at support@yourvillages.com. Message and data rates may apply.

Accuracy and Access to Your Personal Information

We strive to maintain and process your information accurately. If you are a Doula, you may access and update your account information through the Platform's account-management features or by contacting us at support@yourvillages.com. If you are a Client, you may request access, correction, or deletion of your information by contacting your Doula or by contacting us at support@yourvillages.com. Requests will be verified before being fulfilled. Where information has been submitted by a Doula on behalf of a Client, the Doula is the controller of that information; we will work with the Doula to fulfill verified requests as required by applicable law.

Information of Minors

The Platform is intended for adults, and we do not knowingly collect Personal Information directly from children under the age of sixteen (16). Doulas may serve adolescent or young-adult clients in some cases, including in pregnancy and postpartum support; in such cases, the Doula is responsible for obtaining any consents required by law for the use of the Platform with such clients. Information about newborns and minor children of Clients may incidentally be processed in connection with the Doula's services to the Client; such information is handled in accordance with this Policy and applicable law.

How We Use Your Information

The information we collect is used to provide the Platform and to support Doulas in coordinating care with their Clients, including:

  • Providing the services and functionality of the Platform.
  • Authenticating identity and securing accounts.
  • Processing subscription payments (for Doulas).
  • Communicating with you regarding the operation of the Platform and your use of it.
  • Operating, securing, monitoring, and improving the Platform.
  • Complying with legal, regulatory, and contractual obligations.

We do not use your Personal Information for advertising, marketing to third parties, or any purpose unrelated to providing the Platform.

How We Use Artificial Intelligence

The Platform may use artificial intelligence and machine-learning technologies to assist with features such as scheduling, summarization, and information retrieval. AI processing of Personal Information is performed only by sub-processors under appropriate contractual safeguards. We do not permit our AI sub-processors to use your Personal Information to train their general-purpose models, and we do not share your Personal Information with third-party AI providers that have not entered into appropriate data protection agreements with Thanacare.

How We Share Your Information

We do not sell or lease your Personal Information to any third party. We may disclose your Personal Information as follows:

  • With Your Doula. Information you provide as a Client is shared with the Doula who invited you to the Platform, as necessary for the Doula to provide services to you.
  • With Your Clients. If you are a Doula, information you submit through the Platform that is intended to be visible to your Clients (such as scheduling, communications, and shared documents) is shared with those Clients.
  • Sub-processors. We engage trusted third-party service providers ("sub-processors") to operate the Platform. The current named sub-processors are: Amazon Web Services, Inc. ("AWS") for cloud infrastructure, AI processing, and transactional email; and DigitalOcean, LLC for application hosting. Both AWS and DigitalOcean operate under contractual safeguards (including, where applicable, Business Associate Agreements) with Thanacare. Other service providers engaged by Thanacare that do not access health-related Personal Information (such as authentication providers handling only login credentials, and payment processors handling only billing information) operate under their own contractual terms with Thanacare. A current named list is available on request.
  • Compliance with Laws. We will disclose Personal Information when we believe that disclosure is reasonably necessary to comply with any applicable law, regulation, subpoena, or court order; to respond to duly authorized information requests from law enforcement or other governmental authorities; to enforce our agreements, policies, or terms of use; to investigate and help prevent security threats, fraud, or other malicious activity; or to respond to an emergency that we believe in good faith requires us to disclose such information to assist in preventing the death or serious bodily injury of any person.

There are circumstances where the Company may decide to buy, sell, or reorganize its business. Under these circumstances, it may be necessary to share or receive Personal Information with prospective or actual partners, affiliates, successors, or acquirers. In such circumstances, we will require any successor or acquirer to honor this Policy with respect to your Personal Information, or notify you and provide a meaningful choice if a successor's privacy practices differ materially.

Third-party Websites

This Policy does not apply to websites or other domains that are maintained or operated by third parties. The Platform may link to third-party websites and services, but these links are not endorsements, and this Policy does not extend to them.

Your California Rights

If you are a California consumer, as defined by the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (collectively, the "CCPA"), you may be afforded rights with respect to your "Personal Information" as that term is explicitly defined under California law.

The categories of Personal Information we collect from California consumers include identifiers (name, email, phone, IP address); commercial information (subscription and billing information for Doulas); internet or other electronic network activity (cookies, server logs); and, where provided to the Platform, health-related information (which may constitute "Sensitive Personal Information" under California law). The sources of this information include directly from you, from your Doula or your Client, automatically through cookies and analytics tools, and from our service providers. We use this information for the purposes described in "How We Use Your Information."

You may exercise the following rights, subject to verification of your identity:

Access. You may email us at support@yourvillages.com to request a copy of the Personal Information we have about you.

Correction. You may email us at support@yourvillages.com to request that we correct inaccurate Personal Information.

Deletion. You may submit a request via email to support@yourvillages.com to delete Personal Information. For Client information that has been submitted by a Doula, we will route the request to the Doula as the controller and will support the Doula's response as required by law.

Portability. Upon request and when possible, we can provide you with copies of your Personal Information.

Limit Use of Sensitive Personal Information. Where applicable, you may direct us to limit the use of your Sensitive Personal Information.

Opt-Out of Sale or Sharing. We do not sell your Personal Information for monetary consideration, and the Platform does not engage in cross-context behavioral advertising.

To exercise any of these rights, contact us at support@yourvillages.com with the subject line "California Privacy Rights Request." We will not discriminate against you for exercising any right under California law.

Other U.S. State Privacy Rights

Residents of certain U.S. states — including, as of the Last Revised date above, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia — have additional rights under their state privacy laws, which may include rights of access, correction, deletion, portability, opt-out of sale, opt-out of targeted advertising, and opt-out of certain profiling. Washington My Health My Data Act

If you are a Washington resident, the Washington My Health My Data Act ("MHMDA") provides specific rights with respect to "consumer health data," which is broadly defined under that law and may include information about your physical or mental health, reproductive or sexual health (including pregnancy, fertility, and postpartum status), and similar categories. The Platform may collect consumer health data about Washington residents in the course of providing doula services. We collect and process such consumer health data only with your consent, only as necessary to provide the Platform, and only with the categories of recipients described in "How We Share Your Information." We do not sell consumer health data, do not use geofences around healthcare facilities, and apply administrative, technical, and physical safeguards to protect such data.

If you are a Washington resident, you have the right to: (i) confirm whether we are collecting, sharing, or selling your consumer health data and access such data; (ii) withdraw your consent to our collection and sharing of your consumer health data; (iii) request that your consumer health data be deleted; and (iv) appeal our decisions regarding your requests. To exercise any MHMDA right, contact us at support@yourvillages.com. You may also file a complaint with the Washington Attorney General if you believe your rights have been violated.

Do Not Track

The Platform does not operate any differently when it receives "Do Not Track" signals from your internet web browser; however, we honor Global Privacy Control signals as described above under "Cookies."

For Platform Users Outside of the United States

The Platform is designed for use by individuals in the United States only. We do not warrant or represent that this Policy or the Platform's use of your Personal Information complies with the laws of any other jurisdiction. To provide the Platform to you, we may store, process, and transmit information in the United States. Regardless of the country in which information is stored, we will process your Personal Information in accordance with this Policy.

Data Retention

We retain Personal Information for as long as needed to provide the Platform and as required by applicable law. Doula account information is retained for the term of the subscription and for a reasonable period thereafter as required by tax, accounting, and legal obligations. Client information submitted to the Platform is retained for as long as the Doula maintains the Client's record on the Platform, and is deleted, returned, or de-identified at the Doula's direction or upon termination of the Doula's subscription, in accordance with applicable law. Web analytics and server log data is retained in accordance with the retention setting of our service providers, typically 14 to 26 months.

Changes to this Policy

If we make any changes to this Policy, a revised Policy will be posted on this webpage and the date of the change will be reported in the "Last Revised" block above. For material changes, we will use reasonable efforts to provide additional notice. Your continued use of the Platform after we make changes is deemed to be acceptance of those changes.

Safeguarding the Information We Collect

We use reasonable technical, administrative, and physical safeguards designed to protect your Personal Information against accidental loss and unauthorized access, use, alteration, and disclosure. These safeguards include access controls, encryption of Personal Information in transit and at rest, audit logging, workforce training, and incident response procedures. No security program can guarantee absolute security. You have a responsibility to safeguard your information through the proper use and security of any online credentials, including your username and password. If you believe your credentials have been compromised, change your password immediately and notify us.

Breach Notification. If we experience a security incident affecting your Personal Information, we will notify you, the affected Doula or Client (as applicable), and applicable regulators in accordance with applicable state and federal data-breach notification law and the Washington My Health My Data Act, where applicable.
